1859思想的主权OnSovereigntyOfThinkAndOnThinkOfSovereignty

   菲尔麦(Robert Filmer,1588——1653年)《父权制或国王的自然权利》在他死后于1680出版,“大概是君权神授理论至今为止最有系统的英文阐述”;他在该书中把《圣经》中的《创世记》的观点作为他君权神授的逻辑前提。他指出:君权的来源是父亲对子女的支配权,“世界上的一切权力或是从父权派生,或是篡夺父权而来,此外再也找不出任何权力的其他来源。”臣民对君主的服从关系来自子女对家长的从属关系,并且“这种子女的从属关系,按照上帝的命令,是一切君主权力的本源。”因为上帝的授予,亚当拥有了统治其妻子、儿女以及后裔的原始的统治权力。他认为,君主统治国家的权力是按照上帝赋予亚当的父权建立起来的。菲尔麦认为,君权的权力是神圣不可侵犯的、绝对的,它支配着世间一切财富、统率着世上一切臣民、裁断着世间一切事务,“上帝规定亚当的最高权力应该是无限制的,其范围与基于他的意志的一切行为一样广大,亚当如此,其他一切具有最高权力的人们也是如此。”由于亚当对尘世拥有绝对的统治,自然也拥有选择继任君权的继承人的绝对权力。菲尔麦认为:“一个完善的王国,就是君主依照君主其个人的意志进行统治的王国。”世间的法律只不过是根据君主的意志和愿望建立的,“法律不过是具有至高无上的父权者的意志。”因而“君主必须超出法律之上”,无须受自己所制定的法律的控制。不过国王必须遵守上帝之法,对上帝负有义务,他作为“统领许多家庭的父亲,其关心所及在于保存子民、提供衣食,指导和保卫整个国家---一言以蔽之,一个国王的职责归结起来就是给予人民以普遍的、父亲般的关心。” 菲尔麦极力为英国的专制制度辩护,认为英国国王是亚当的继承人,是唯一的主权者,他享有制定法律、发号施令的绝对的无限权力。至于国家的其他机构,只能是王权的附属物,都不可享有主权。“最高的权力是落在父亲的身份上,并且只限于一种形式的政府,这就是君主制。”政府的目的在于“敬神与和平”,而这个目的只有君主制能够达到。
